1. Object

  • “SADNAN” is the trading name for the Sadnan delivery ltd.

  • SADNAN is a delivery and technological company whose primary business is the development and management of a technology platform through which merchants, pharmacies, supermarkets, and restaurants in a variety of areas may offer their goods and/or services via a mobile or web application on the platform (hereinafter, the "APP") . SADNAN serves as an intermediary for the scheduled or immediate delivery of products by SADNAN couriers.  In addition, it manages a digital marketplace ("marketplace") for the purchase and selling of consumer goods and services within its designated region.

  • SADNAN also functions as a logistics firm, facilitating the movement of commodities within its designated region.

  • SADNAN has created a platform through which a number of vendors, with whom SADNAN have a commercial agreement for the use of the platform, can sell a range of goods and/or services.

  • SADNAN functions as a mere intermediary and is therefore unwilling to assume responsibility for the quality of the goods being sold or the appropriate provision of the services offered directly by merchants or by such third parties. Except for Sadnan Supermarket, which is sold by SADNAN

  • Furthermore, SADNAN is a multi-category Technology Platform for intermediation in the contracting of "on demand" services through distant electronic means. The intention is to make life simpler for those who might use some assistance with things like running errands or making purchases for delivery goods

 

2. Terms of Use

  • All Users acknowledge and fully and clearly agree to these General Terms of Use and Contracting as well as the Privacy Policy and the Cookie Policy by visiting the Platform and voluntarily creating a profile.

  • You acknowledge these general terms and conditions in full by using our marketplace. If you disagree with any portion of these general terms and conditions, you must not use our APP or WEBSITE marketplace.

 

3. User Access and Registration

  • To be a User of the Platform, you must meet the following requirements:

    • Users must be at least 18 years of age.

    • Users must truthfully complete the compulsory fields of the registration form requesting personal details such as the User’s name, e-mail address, telephone number and bank card number.

    • Users must agree to these Terms of Use and Contracting.

    • Users must agree to the Privacy and Data Protection Policy.

    • Users must agree to the Cookie Policy.

  • The User warrants that all information about his/her identity and capacity provided to SADNAN in the Platform registration forms is true, accurate, and full. Users also agree to keep their details up to date.

  • SADNAN reserves the right to terminate a User's access to the Platform and/or any of its contents and/or services if the User provides any information that is false, inaccurate, or incomplete, or if SADNAN has sufficient reason to doubt the truthfulness, accuracy, or integrity of such information.

  • When registering on the Platform, Users must choose a username and password. Your login credentials (username and password) are strictly confidential and should not be shared with anyone else.

  • SADNAN advises Users not to reuse their logon credentials from other platforms in order to increase account security.

  • The user agrees that they will not share their account information or provide anybody else access to their account. Users are solely liable for any use of their details or of the Site's services that may be made by third parties, including the statements and/or content entered on the Platform, as well as for any other action taken using their username and/or password.

  • Users are the sole owners of the content entered by them on the Platform.

  • SADNAN cannot guarantee the identity of registered Users, and it will therefore not be liable for the use by unregistered third parties of a registered User’s identity. Users agree to notify SADNAN promptly if their credentials are stolen, leaked, or lost by utilizing the appropriate communication methods made accessible by SADNAN.

  • If we cancel any services or goods that you have paid for but not received and you didn't violate these general terms and conditions, we will refund you in respect of the same. 

  • We reserve the right to suspend or cancel your account and/or make changes to your account details at any time in our sole discretion and without notice or explanation.

  • In order to terminate your account on our market, please contact us.

 

4. Terms and conditions of sale

 

You recognize and acknowledge that:

  • The marketplace gives sellers and buyers a place to sell and buy goods online;

  • We will accept guaranteed sales on behalf of sellers, but SADNAN is not a part of the deal between the seller and the buyer (unless SADNAN is listed as the seller); and

  • When the buyer confirms purchase through the marketplace, a contract for the sale and purchase of a product or products goes into effect between the buyer and seller. This means that you agree to buy or sell the product or products in question.

  • Aside from these basic terms and conditions, the buyer and seller's deal to sell and buy will be based on the seller's business terms. Even so, the following clauses will be added to the sale and purchase agreement between the buyer and the seller:

  • The price of a product will be what it says in the description for that product;

  • The price of a product must include all taxes and comply with any rules that are in effect at the time;delivery costs, packaging costs, and handling fees administrative duties insurance expenses and other ancillary costs and fees, if applicable, will be the buyer's responsibility only if expressly and plainly indicated in the product listing and digital goods can be delivered electronically, products must be of good quality, fit for the purpose listed, and safe. They must also match the product offering and any other description the seller gives or makes available to the buyer

  • The seller warrants, with respect to physical products sold, that the seller has good title to and is the sole legal and beneficial owner of the goods in question and/or has the right to supply the products pursuant to this agreement and that the products are not subject to any third party rights or restrictions, including with respect to third party intellectual property rights and/or any criminal insolvency or tax investigation or proceedings; and with respect to digital products sold, the seller warrants that the seller has good title to and is the sole legal and beneficial owner of the products

 

 

5 Returns and refunds

  • When a customer orders a product or service through SADNAN Food, SADNAN online stores, or SADNAN pharmacy, these companies only act as an intermediary. This means that SADNAN Food, SADNAN online stores, or SADNAN pharmacy cannot be held responsible for the quality of the product or service offered by the Member Business or for making up for any losses caused by the Member Business in connection with the product or service offered on the App.

  • When it comes to SADNAN Supermarket, the items or things are sold by the SADNAN company. It is not an intermediate store, so SADNAN will handle the procedures directly.

  • The SADNAN Logistics shall have a no-refund policy once the assignment is completed.

  • Refunds for cancellations and returns can be different depending on how the customer paid for the item or service in the first place. Refunds for payments made with credit or debit cards will follow the regulations of the banks involved.

  • Refunds may take between 5 and 7 business days to reach your bank account of choice.

  • First, refunds will be sent to the customer's SADNAN App wallet, which will make it easy for them to place future orders. However, a customer can ask for a bank return. 

  • The User acknowledges that, in the case of perishable products (such as food), the product may not be returned, and that SADNAN will be entitled to charge him/her for both the already-purchased product and the cost of the delivery service.

 

SADNAN Food orders are only eligible for a refund under the following the circumstances:

  1. mandatory cancellation of the order due to failure to communicate the order to the relevant restaurant or the restaurant's inability to prepare or deliver the order due to events such as excessive volume, lack of courier, power failure, or accident;

  2. cancellation by Customer as approved by the Member Business, if the order has not yet been prepared; 

  3. cancellation upon approval of the relevant Member Business in the event of late delivery of the product ordered.

  4. mandatory partial or full cancellation of the order due to partial or full lack of order supply.

 

 

SADNAN Supermarket SADNAN Food orders are only eligible for a refund under the following the circumstances:

  1. mandatory cancellation of the order due to failure to communicate the order to the relevant restaurant or the restaurant's inability to prepare or deliver the order due to events such as excessive volume, lack of courier, power failure, or accident;

  2. cancellation by Customer as approved by the Member Business, if the order has not yet been prepared; 

  3. cancellation upon approval of the relevant Member Business in the event of late delivery of the product ordered.

  4. required partial or full cancellation of the order due to partial or full lack of order supply; 

  5. cancellation due to incorrect, damaged, or defective product.

 

SADNAN Pharmacy orders are only eligible for a refund under the following the circumstances:

  1. mandatory cancellation of the order due to failure to communicate the order to the relevant restaurant or the restaurant's inability to prepare or deliver the order due to events such as excessive volume, lack of courier, power failure, or accident;

  2. cancellation by Customer as approved by the Member Business, if the order has not yet been prepared; 

  3. cancellation upon approval of the relevant Member Business in the event of late delivery of the product ordered.

  4. mandatory partial or full cancellation of the order due to partial or full lack of order supply.

 

 

SADNAN online shopping stores orders are only eligible for a refund under the following the circumstances:

  1. Wrong Items: If the products shipped don't match what was shown on the website, the return will be approved after verification, and the item cost and shipping fee will be returned once the item is sent back.

  2. Incomplete Item: What was shown on the website is only part of what was sent. If the item cannot be completed, a return will be authorized upon validation. When the item is sent back, both the cost of the thing and the shipping fee will be returned.

  3. Defective Items: The product was made wrong and was dead when it arrived. A return will be allowed after it has been checked.

  4. Damaged (in transit): The product has damage that can be seen, and a return will be approved after it has been checked. You have 24 hours to file a complaint.

  5. Product Standard: If the product doesn't work as expected or can't do what it's supposed to, a return will be allowed after approval.

  6. The items being returned must also have tags or labels attached, be in their original package, complete accessories and free gifts, new condition and undamaged state.

 

In any case, the return will be subject to the merchant's return policies.

 

 

 

6. Prices of the Goods, Services Billing and The Goods Appearing on the Platform

  • The goods sold by the supermarket will be priced by SADNAN as the retailer of the goods in the marketplace.

  • However, the prices of the goods sold in restaurants and/or stores shown on the SADNAN Platform may be indicative only. In any case, they correspond to the goods  sold in restaurants and/or stores, and they are set solely by them.

  • If the User entered an incorrect delivery address for the products, he or she may input a new one. In such a circumstance, the User will be ordering a new service and agreeing to pay the applicable fees for the new delivery.

  • SADNAN has the right to cancel an order without giving a good reason.  If SADNAN decides to cancel without a good reason, the User is eligible to be refunded the amount paid.

  • In the event of rain or poor weather, the User will be required to pay an additional fee for the courier or dispatch service provided in such conditions.

  • In addition, for services that include the purchase of a product, the User must pay the price of such product. By signing up through the Platform and giving SADNAN the necessary bank information, Users give their clear permission for SADNAN to issue receipts for payment of the services asked, such as the price and delivery of the goods purchased.

  • Furthermore, the User accepts that all the products appearing on the SADNAN platform are subject to availability

  • SADNAN reserves the right to withdraw any product from its platform, as well as to modify the contents of its information sheet at any time, without thereby incurring any liability of any kind.

  • The total price of each service may include an amount that changes based on how many kilometers were driven.

  • SADNAN has the right to change the price based on the distance traveled and/or the time slot in which the service is done.

  • In accordance with these terms, the User will be entitled to know the approximate fee for the service together with goods total price before contracting it and paying for it, unless the User has not specified the address for collection. The charge for the delivery service may change in circumstances of force majeure outside SADNAN's control that necessitate an increase in such fee.

  • The fee may include tips for the courier and/or the local store. The User decides how much to tip the courier and/or the local store.

  • SADNAN reserves the right to change the prices on the Platform at any time. These changes will take effect as soon as they are published. The User gives SADNAN explicit permission to send him or her receipts and/or bills for the services hired and/or made to the e-mail address the User gave during the registration process. If an invoice is required, the User must enter the relevant tax data on the platform before placing the order.

  • If a service is canceled by the User after the preparation of the order by the local merchant or restaurant has been confirmed and the User has been notified, SADNAN reserves the right to charge the User the applicable fee in each instance. All this without prejudice to the User’s ability to request a new service in order to return the products purchased or to have them delivered at a different address.

 

 

7. Payments Platforms

  • You must make payments required by these general terms and conditions in accordance with the Payments Information and Guidelines posted on the marketplace.

  • Payment for products and/or services offered on the Platform, at restaurants and/or stores, and delivered to Users on a deferred basis is made temporarily to SADNAN, who then forwards it to the restaurants and/or stores with which it has a commercial agreement. The affiliated restaurants and/or stores authorize SADNAN to accept payments on their behalf. Payment of the price of any product (such as food, drink, a gift, etc.) made to SADNAN fulfills the User's obligation to pay the price to the associated restaurants and/or establishments.

  • Payment by Users for products and/or services is received at SADNAN’S accounts through a Bank Transfer or an Electronic Money Institution. Electronic Money Institutions are permitted to provide, directly or indirectly, regulated payment services in all territories where SADNAN operates and are in compliance with the current legislation applicable to payment services for Platforms such as SADNAN.

  • If such institutions are not authorised, SADNAN will accept no liability for such lack of authorisation or licence, and sole and exclusive liability shall lie with the Electronic Money Institutions.

  • SADNAN reserves the right to use the payment provider it hired for this purpose and only for the purpose of verifying the means of payment provided. To help users more, SADNAN will be their first point of contact and will be responsible for payments made on the Platform. Such liability includes refunds, returns, cancellations and early-stage dispute resolution, and it is without prejudice to any actions that may be taken by SADNAN vis-à-vis local merchants as the sole physical sellers of the products ordered by Users.

  • In accordance with the aforesaid, in the event of a dispute, SADNAN will provide initial support and will reimburse the User if deemed appropriate.

  • If a User has any questions or concerns about the status of his/her order, he/she may contact SADNAN's User assistance service via the means made available on the Platform.

 

8 Price and Payment Method

  • The price of the product and/or service shall be as listed on the Platform by the establishment. However, the User is aware that the price of some products may fluctuate in real time based on stock availability at the establishments listed on the platform, and that the User will always be informed of the final price prior to making a purchase.

  • Similarly, at the payment gateway stage, the User will be informed of the final price and estimated delivery time in accordance with the above-described terms of SADNAN's courier service.

  • The User may pay for products and/or services via bank transfer, point-of-sale terminal, cash, or credit card. The option to pay with cash may be unavailable for some orders. At the time of order placement, the User will be informed of the available payment methods.

  • SADNAN does not retain card numbers on its servers and is only able to view the last four digits of a card number. The complete information will be retained on the servers of the payment service provider that processes payments on behalf of SADNAN.

  • In the case of cash payments, the User must pay the price upon delivery of the product and/or completion of the assignment at the delivery location. The User may not refuse to pay the delivery charge and/or the cost of the ordered product.

  • If payment for the service cannot be collected from the User for any reason, the User's account will be blocked until the problem is resolved and the debt is settled.

 

 

 

9. Promotional Codes and/or Other Offers or Discounts

  • SADNAN may unilaterally provide credits redeemable on the Platform or free shipping to certain Users at any time. The User acknowledges and agrees that credits and free shipping must be utilized prior to their expiration date.

  • Before placing an order, promotional codes and/or other offers or discounts made available on the Platform must be accurately inputted in the application. Otherwise, they will have no effect and the User will be unable to take advantage of them.

  • Whenever SADNAN requests cancellation, the User must ensure that the promotional code and/or other discount or offer is invalid for future use.

  • SADNAN reserves the right to unilaterally cancel promotional codes and/or other offers or discounts if it becomes aware of a fraudulent use thereof (such as a promotional code being redeemed by someone who is not its intended recipient, the mass communication of codes, or the sale of codes or discounts) at the end of the above mentioned period. Furthermore, it reserves the right to apply sanctions to Users for the amount for which SADNAN has been defrauded as a result of such use.

  • SADNAN will accept no liability if, due to an event of force majeure or other events beyond its control or whose need is justified, it is forced to cancel, shorten, extend or amend the conditions of promotions.

  • In particular, SADNAN assumes no responsibility if the website is unavailable at any point during promotions or if the automated promotion system malfunctions.

 

10. Deliveries

  • SADNAN performs deliveries in the areas designated by it where orders may be placed on the App.

  • Once the Customer selects a delivery address on the App, products within the relevant designated area and assigned to the relevant designated area are displayed to the Customer.

  • The delivery time displayed to the Customer on the App is a non-binding estimate of when SADNAN intends to complete delivery. SADNAN is not responsible if the Product is not delivered within the estimated time frame.

  • The purchase price of the product, delivery fees, delivery vehicle fees, and any and all other additional fees, including taxes, duties, and charges, shall be deducted, as specified in the Agreement, from the Customer's credit/debit card, bank transfer, or other payment method.

 

  • The product will be delivered to the address supplied by the Customer during order placement; this address cannot be altered after order placement. SADNAN assumes no liability if Customer or the designated recipient is not present at the delivery address, if they refuse to accept delivery of the Product, or if the address is inaccurate; in such cases, SADNAN will be deemed to have done its job full. Any and all losses resulting from the Customer's late acceptance of the delivery of the Product will incur additional fees, as will any and all costs resulting from the Product being held due to Customer fault and/or returned to SADNAN due to non-delivery. SADNAN may suspend performing services to those customers abusing such situation.

  • For orders placed on SADNANFood, SADNAN Supermarket, SADNAN Pharmacy, and SADNAN store, delivery is subject to the availability of Member Businesses at the time of order. SADNAN may be unable to deliver products that are unavailable from the applicable Member Business. The display of products on the App does not imply that they are in stock at the Member Business.

  • SADNAN may correct the error and perform delivery or cancel the order by notifying Customer in the event of an error in the prices or product features of Member Business’ product/services offered on the App. SADNAN shall exercise reasonable care in providing true and accurate information regarding the content of the products offered by the Member Business on the App; however, SADNAN shall not be liable for any problems or losses that may arise as a result of incomplete and/or inaccurate information provided by the Member Business in relation to order content.

  • SADNAN provides Users with a delivery service for products purchased by a user. The following conditions must be fulfilled at the time of payment before such an order can be executed:

    • The service must be operative during the chosen time slot.

    • The goods to be delivered must be in one of the available area, in which SADNAN operates.

    • Depending on the quantity of items, SADNAN may need to use a car which will incur additional fees.

 

11. Logistics/Package Delivery Terms of the Service through SADNAN

  • In terms of package delivery. The user would be liable for any incident resulting from the nature of the products (including sanctions, civil and/or criminal liability, financial liability, etc.). Users should be aware that SADNAN actively collaborates with authorities to combat fraud, drug trafficking, money laundering, terrorism, and identity theft, among other offenses. The User is therefore aware that SADNAN may disclose his or her data to public authorities upon their request in order to prevent and avoid the commission of these or other crimes.

  • illegal items are prohibited Items sent via SADNAN courier must adhere to all applicable laws, regulations, and company policies. Violations may be reported to authorities and app access may be removed. SADNAN will cooperate with law enforcement to investigate any illegal act.

 

 

 

Prohibited Items for delivery.

You may not use or access SADNAN Courier or the provided delivery services to dispatch any Prohibited Items (collectively referred to as "Prohibited Items").

 

The list of Prohibited Items includes, but is not limited to:

  1. People and animals other than those authorized in writing to be sent by the relevant public institutions and organizations, such as bees, silkworms, and leeches; and inanimate animals other than those that have been dried or otherwise preserved.

  2. illegal items and any substance that is prohibited by law from being bought, sold, transported, or exchanged.

  3. Bullets, empty shell casings, pistols, fireworks, cartridges, shotguns, and all types of airguns and firearms.

  4. Alcohol 

  5. Degradable biological substances and radioactive substances

  6. Tobacco and smoking-related products

  7. Negotiable instruments such as checks, promissory notes, stock certificates, bonds, etc., gold and silver, precious metals and money, and other items whose transportation is prohibited by law.

  8. Hazardous substances and similar substances that may threaten people due to their nature and character or packaging, damage postal shipments, flare up, ignite, or explode.

  9. Stolen goods

  10. Postal mails containing signs, pictures, and writings that are contrary to the general moral rules or impair security and encourage the commission of a crime.

 

12. Products from Pharmacies

  • In accordance with the current legislation, SADNAN does not sell or advertise medicines for human use through the Platform. We are just an intermediary to Users who order, through the Platform, non-prescription drugs for human use for collection.

  • In any case, SADNAN will not be liable for the quantities and/or conditions of the products dispensed at pharmacies, nor will it be responsible for the use of the products ordered in the Pharmacy section.

  • In addition, the Platform may provide the pharmacy dispensing the medication ordered by the User with the User's username and phone number so that the pharmacy may respond to the User's inquiries. This disclosure of data will in any event be subject to the User’s express and unambiguous authorisation in accordance with the applicable data protection legislation.

 

13. Geolocation

  • SADNAN may collect, use, and disclose precise location data, including the real-time geographic location of the User's computer or mobile device, if the User has given permission. The said location data may be collected and used by SADNAN to show Users the location of the point of origin and/or destination of an assignment. In this regard, Users expressly consent to the sharing of their geolocation data with other Users and Suppliers in order to effectively complete the requested assignment at any given time.

  • The User shall be liable for entering the correct addresses for collection and delivery. In this regard, SADNAN assumes no liability for errors or omissions in the User's provision of such addresses.

 

14. The User’s Obligations

  • Users are solely responsible for the correct use of and access to their profile and other Platform content in accordance with applicable law and the principles of good faith, morality, generally accepted customs, and public order. Specifically, they agree to comply with these General Terms of Service with diligence.

  • Users are liable for correctly entering their individual usernames and passwords, which should be non-transferable and must be sufficiently complex, and for not using the same username and password on other platforms, in order to protect their accounts from fraudulent use by third parties unaffiliated with the Platform.

  • Users are prohibited from using their profile and other Platform content for illegal purposes or with illegal results that violate the rights or interests of third parties, or that may in any way damage, disable, affect, or impede the Platform and its contents and services. In addition, they are prohibited from hindering other Users’ normal use or enjoyment of the Platform.

  • SADNAN may not be deemed to have editorial responsibility, and it expressly states that it does not identify with any opinions that may be issued by Users of the Platform, whose consequences shall be the sole responsibility of their issuers.

  • Customer acknowledges that all orders and purchases made through the App are for personal use and consumption only, and are not intended for resale.

  • Any individuals who breach the above obligations shall be liable for any loss or damage caused by them. SADNAN assumes no liability for any consequences, losses, or damages that may result from such unauthorized use or access by third parties.

 

In general, Users undertake, by way of example without limitation:

  • To refrain from altering or modifying the Platform, in whole or in part, by bypassing, disabling, or otherwise tampering with its functions or services; 

  • To refrain from infringing industrial and intellectual property rights or the personal data protection legislation; 

  • To refrain from using the Platform to insult, defame, intimidate, or harass other Users or to attack their image; -

  • To refrain from accessing other Users' e-mail accounts; 

  • To refrain from introducing computer viruses or other

  • To refrain from using our marketplace to link to any website or web page that, if posted on our marketplace, would violate these terms and conditions.

  • To refrain from interfering with a transaction by contacting another user to buy or sell an item listed on the marketplace outside of the marketplace; or communicating with a user involved in an active or completed transaction to warn them away from a particular buyer, seller, or item; or contacting another user to collect any payments.

 

  • Any User may report another User if he or she believes the latter has violated these Terms of Service. Similarly, any User may notify SADNAN via the Contact Form of any abuse or violation of these terms. SADNAN will review such reports as quickly as possible and will take any action it deems appropriate, reserving the right to remove and/or suspend any User from the Platform for violation of these Terms of Service. In addition, SADNAN reserves the right to remove and/or suspend any message containing unlawful or objectionable material without prior notice or consent.

  • The marketplace's review function can be used to facilitate consumer product evaluations. You are prohibited from using the review function or any other form of communication to post inaccurate, unauthentic, or false reviews.

  • You acknowledge that all users of the marketplace are solely responsible for their interactions with other users, and you agree to communicate with caution and good judgment. You are not permitted to send them personal information, including credit card information.

 

15. De-registration by Users

  • Users can de-register from the Platform by using the Contact Form on the Platform.

 

16. SADNAN’s Responsibility

  • Users are responsible for having in place the necessary services and equipment to browse the Internet and access the Platform. Users can report any incidents or problems accessing the Platform to SADNAN via the contact channels made available to Users, and SADNAN will examine the incident and provide the User with instructions on how to resolve it as soon as possible.

  • We do not guarantee any commercial results regarding the use of the marketplace.

  • SADNAN does not control and is not responsible for the content uploaded by Users via the Platform; Users are solely liable for the lawfulness of such content.

  • SADNAN is not liable for any service interruptions, connection errors, unavailability of, or defects in, the Internet access service, or Internet interruptions, or for any other incidents that are beyond its control.

  • SADNAN assumes no responsibility for any security errors that may occur or for any damage that may be caused to the User's computer system (hardware and software), or to the files or documents stored therein, as a result of: 

  • The presence of a virus in the User's computer system or mobile handset used to connect to the Platform's contents and services; 

  • A browser malfunction; 

  • The use of outdated versions thereof.

 

17. Our rights to use your content

  • You grant us a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, store, adapt, publish, translate, and distribute your content on our marketplace, across our marketing channels, and in any media now known or later developed.

  • You grant to us the right to sub-license the rights licensed under section

 

  • You grant us the right to file a lawsuit for the infringement of the rights licensed under Section.

  • You hereby renounce all moral rights in your content to the maximum extent permitted by law, and you warrant and represent that all other moral rights in your content have also been waived to the maximum extent permitted by law.

  • Without prejudice to our other rights under these general terms and conditions, we may delete, unpublish, or modify any or all of your content if you violate our content rules in any manner or if we have a reasonable suspicion that you have violated our content rules.

 

 

 

18. Liability for Contents

  • SADNAN does not control (and is under no obligation to control) how Users use the Platform.   • When a user contacts a courier or delivery man outside of the SADNAN platform to designate him an assignment or place an order. The user is personally liable for anything that occurs, and SADNAN has no involvement.

  • SADNAN rejects any liability for damages of any kind that may arise from Users’ illegal use of the Platform or due to the information supplied by Users to other Users about themselves being untrue, no longer valid, incomplete and/or false and, in particular and without limitation, for any loss or damage of any kind that may arise due to a User impersonating a third party in any kind of communication made through the Platform.  In particular, SADNAN assumes no responsibility for the use of the Platform or for any orders placed by a third party using the User's account.

  • There may be links within the Application that lead to websites or content not managed by SADNAN. SADNAN assumes no liability for the content, products, or services offered on the portals or websites accessed through said links

  • SADNAN reserves the right, notwithstanding the foregoing, to fully or partially restrict the access of certain Users to the Platform, as well as to cancel, suspend, block, or remove certain types of content, using appropriate technological tools, if it becomes aware, or there are indications, that the activity or the information stored is illegal or harmful to the rights or property of a third party. In this regard, SADNAN may implement any filters deemed necessary to prevent users from uploading illegal or harmful content to the Internet. By making content available via the Platform, Users assign to SADNAN all exploitation rights arising from the contents thus supplied.

  • Additionally, SADNAN reserves the right to decide on the algorithms and parameters applicable to the ranking of the merchants (restaurants and/or stores) and products that appear in the Platform, as well as to amend and update it. The User acknowledges and agrees that said ranking may depend on multiple factors and metrics, including, but not limited to, the proximity and accessibility of the store, prior reviews, and as well as any agreement reached by SADNAN with said merchants or distributors of the products regarding their positioning and visibility.

 

19. No Warranty in Assignments or Payments

  • SADNAN gives no warranties regarding the authenticity, accuracy, novelty, reliability, lawfulness or non-infringement of third-party rights by Stores, Restaurants or merchant. In this regard, Users acknowledge that SADNAN is a technology platform whose primary activity is intermediation; that is, it connects Users and Stores; and that it accepts no liability arising from the information they provide or for any loss or damage that may result from a breach of these General Terms of Use.

  • You acknowledge that:

  • SADNAN facilitates a marketplace for buyers and third party sellers or SADNAN where SADNAN is the seller of a product;

  • the relevant seller of the product (whether SADNAN is the seller or whether it is a third party seller) shall at all times remain exclusively liable for the products they sell on the marketplace; and

  • if a problem arises from the purchase of a product on the marketplace, the customer must seek redress from the relevant store or vendor by following the procedure outlined in SADNAN'S Dispute Resolution Policy.

  • We commit to ensure that SADNAN or third party sellers as applicable submit information relating to their products on the marketplace that is complete accurate and up to date and pursuant thereto:

  • the relevant seller warrants and represents the completeness and accuracy of their information published on our marketplace relating to their products;

  • the relevant seller warrants and represents that the material on the marketplace is up to date; and

  • If a buyer has a complaint regarding the accuracy or completeness of the product information received from a seller (including when SADNAN is the vendor), the buyer may seek recourse from the relevant seller by following the SADNAN Dispute Resolution Policy.

  • SADNAN makes no assertions or confirmation regarding any delivery man or their identity or background information. Despite the foregoing, SADNAN may conduct additional checks and initiate procedures to assist in confirming or verifying the identity of the delivery man.

  • When delegating an assignment to a particular Mandatary, SADNAN advises Users to always exercise common sense and remain cautious.

  • By becoming members of the Platform, Users agree that any claims they wish to bring for legal liability arising from the actions or omissions of other Users of the Platform or third parties shall be limited to such Users or third parties, and no liability actions may be taken against SADNAN.

 

20. Updates and Changes to the Platform

  • SADNAN reserves the right to amend these General Terms of Use, the Privacy Policy and the Cookie Policy at any time and without prior notice.
